Ontario County (N.Y.) District Attorney Michael Tantillo announced Tuesday that evidence from the investigation of NASCAR driver Tony Stewart's involvement in the death of Kevin Ward Jr. will be forwarded to a grand jury.
Stewart, 43, has not been charged in the case. His sprint car struck and killed Kevin Ward Jr. at a dirt track on the Ontario County fairgrounds on Aug. 9. The coroner ruled that Ward Jr., who left his sprint car during a race and walked onto the track Stewart was racing on, died to due blunt force trauma.
'Upon my review of all of the information contained in the entire investigation, I have made the determination that it would be appropriate to submit the evidence to a grand jury, for their determination as to what action should be taken in this matter,' Tantillo said in a statement released to the media.
'As grand jury proceedings in New York State are strictly confidential by law, I am unable to state when the matter will be scheduled, other than to state that I intend to present the matter in the near future.'
Stewart returned to racing Memorial Day weekend. Fans applauded him with a standing ovation. In the days after Ward Jr.'s death, Stewart sent Ward Jr.'s family flowers and said he was grieving, as well. Family and friends of Ward Jr. have blamed Stewart for his death.

Ward Jr. was 20 years old.
Stewart released a statement promising to 'continue to provide my full cooperation.'
'I respect the time and effort spent by both the Ontario County District Attorney and the Sheriff's Office in investigating this tragic accident. I look forward to this process being completed.'
