The man found guilty on three counts of attempted second-degree murder in the Florida gas station shooting death of a teenager over loud music faces a new trial after jurors failed to deliver a first-degree murder verdict.


Michael Dunn, 47, will go on trial at Duval County Courthouse for a second time on Monday when jury selection begins in the shooting death of 17-year-old Jordan Davis during a dispute at a Jacksonville gas station in November 2012, The Florida Times-Union reported.


Dunn fired at Jordan and three friends after they pulled up next to him in an SUV. He says he responded to a threat and saw a gun. Jurors in February convicted Dunn, who pulled a handgun from his glove box, of attempted murder for firing at the other three teens, but were deadlocked over first-degree murder charges in Jordan's death.

Dunn, a software developer from Brevard County, was in Jacksonville for his son's wedding. He fired 10 shots at the SUV, nine of which struck the vehicle as it drove off. Only Jordan, from Marietta, Ga., was hit. The jury deliberated for 30 hours over four days before coming back with a split decision.


'Dunn wasn't just an attempted murderer that night. He killed a teenager. A son. A hope for a bright future for Ron and Lucy, full of a wedding, grandchildren and fulfilled dreams,' John Phillips, family lawyer for Jordan's parents, told Florida Today.


Already facing at least 60 years in prison on his current conviction, Dunn could get life without parole if he's found guilty in the retrial.


Dunn, who will head into the retrial with new lawyers, has requested the second trial be moved from Jacksonville based on widespread publicity, the Times-Union reported. Corey Strolla, who was hired by Dunn's parents, withdrew from the case after the family ran out of money following the first trial.


Circuit Judge Russell Healey said the trial could be moved to another city, but the defense had to make an attempt at jury selection first.
